A condition of your permit requires that you enter into a Deed of Agreement with the Great Barrier Reef Marine Park Authority and sometimes the Queensland Parks and Wildlife Service (QPWS). It is a formal commitment between you and the managing agencies about how you will operate in the Marine Parks.
What's in the deed?
The Deed of Agreement (see Download) includes provisions relating to:
- complying with and abiding by the conditions of your permit;
- the removal of works from the Marine Parks;
- indemnifying the GBRMPA and/or QPWS;
- maintaining a specified level of insurance;
- paying a bond for structures other than vessel moorings;
- the non-assignability of the deed (in that the permittee always remains responsible unless there is prior consent from the GBRMPA).
If you hold a 15-year permit there are additional provisions relating to:
- the ability for information about you, your product and your permit to be exchanged between the approved Certification Scheme and the GBRMPA; and
- ability for the approved Certification Scheme and the GBRMPA to inspect, monitor and/or audit the conduct of such certified product activities.
What do I do with the Deed?
The Deed of Agreement will be forwarded to you with your permit along with instructions on how to execute the Deed. You must correctly sign, seal and deliver your Deed to the GBRMPA within 30 days of commencement or transfer of the permit.
How long does the deed last?
The Deed lasts as long as your permit for the provisions about insurance and complying with your permit. For all other aspects, the deed lasts for a further 6 years.
