To ensure that tourism opportunities are made available to bona fide operators, you must commence operations in the Marine Park within the first two years of being granted a new permit or a further permit. In particular cases, a shorter period may be specified on individual permits.
This requirement is part of GBRMPA policy on tourism permits and applies to all tourism permits granted after 13 August 2003 (see Related Links).
How much do I have to use my permit?
You are simply required to have begun operating in the Marine Park during the initial two-year period. There is no requirement to have operated a specific number of days.
If you hold a 'special tourism permission' there is also a requirement to make reasonable use of the permit over the complete term of the permit.
How do I demonstrate use?
Usually you will be able to demonstrate that you have commenced operation by referring to Environmental Management Charge logbook data. You may also include use within the State Great Barrier Reef Coast Marine Park. Other evidence may also be considered (e.g. ship's logs).
Can I get an extension?
If there are valid reasons why you were unable to commence operation, you may apply in writing to the GBRMPA for an extension of the two-year timeframe. Requests should be made in advance and will be considered on a case-by-case basis.
What happens on transfer?
The commencement period remains the same on transfer and operations must still have begun within the original two-year commencement period. However, if necessary, the new permittee may make a written request for an extension of the commencement period.
What happens if I don't commence operation?
If you have not commenced operation within the period, your permit may be revoked.
